Vape age of sale and proxy purchasing: the UK rules

Vapes are 18+. Selling nicotine vapes to someone under 18 is an offence, and so is an adult buying one for them. From 29 October 2026 the 18+ sale rule covers nicotine-free vapes too, which closes the last obvious gap.

The rule as it stands

Two offences have been in place for years under UK regulations. It is an offence to sell a nicotine vape or nicotine e-liquid to anyone under 18. And it is an offence for an adult to buy one on behalf of someone under 18, which is what proxy purchasing means.

Neither rule depends on where the sale happens. A corner shop, a market stall and a website are all selling, so all of them need to make sure the buyer is an adult.

Adult vapers buying for themselves are not affected at all, beyond being asked for proof of age now and then. If you get asked, it is a shop doing its job.

What counts as proxy purchasing

Proxy purchasing is simple: an adult buys a vape that is really for someone under 18. It does not matter whether money changes hands, whether the adult is a parent or a mate, or whether the younger person is 17 and a half. If it is bought for them, it counts.

The rule exists because age checks at the till are pointless if anyone over 18 can walk in and buy on a teenager's behalf. Shops sometimes refuse a sale when they suspect a proxy buy, for example if a younger person is clearly choosing the product.

The NHS puts its position plainly: "Children and non-smokers should never vape."

Who is the vape actually for?

29 October 2026: all vapes, no exceptions

Until now, the age of sale offence covered nicotine products. That left nicotine-free vapes in an awkward grey area. The Tobacco and Vapes Act 2026 closes it: from 29 October 2026 the 18+ sale rule extends to all vapes, including non-nicotine ones, according to ASH.

The same date brings a ban on selling vapes from vending machines, an end to free samples and big discounts on vapes, and £200 fixed penalties for breaking the rules.

For shops, that means checking age on every vape sale, whatever its strength. For adults, the simplest rule of thumb is: do not buy any vape for anyone under 18, nicotine or not.

Age rules sound simple, but a few misunderstandings come up again and again, usually around nicotine-free products and buying on someone else's behalf.

The nicotine-free one is time-sensitive. Before 29 October 2026, the age of sale offence covered nicotine vapes. From that date it covers all of them. The proxy one is not time-sensitive at all: buying a nicotine vape for an under-18 has been an offence for years.
