The Tobacco and Vapes Act 2026, explained for vapers

The Tobacco and Vapes Act became law on 29 April 2026, but it switches on in stages. For vapers, the first big change is 29 October 2026, when the 18+ rule covers every vape; for smokers, it is 1 January 2027, when the generational tobacco rule starts.

The short version

What the Act is

The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. It is the big framework law behind most of the changes you will hear about over the next year: age rules, sales rules, advertising and more.

Crucially, it does not all start at once. Some parts have fixed dates. Others, like rules on packaging and vape-free places, have been consulted on but have no start date. A licensing scheme and a product register are still to come.

So when a headline says the Act bans something, the useful follow-up is always: from when?

29 October 2026: what changes for vapes

This is the first date that matters for vapers, according to ASH. Four things happen.

The 18+ rule extends to all vapes, including nicotine-free ones. Until now, the age of sale offence covered nicotine vapes. The vending machine ban extends to vapes. Free samples and big discounts on vapes are banned. And breaking the rules can bring a £200 fixed penalty.

If you are an adult buying for yourself, none of that changes how you shop. It does change how shops promote vapes, which is why you may notice fewer giveaway-style offers.

The generational tobacco rule

From 1 January 2027, anyone born on or after 1 January 2009 can never legally be sold tobacco. As each year passes, the group who can buy tobacco stops growing.

This rule is about tobacco. It does not stop adults of any age buying vapes. Vapes stay an 18+ product, with the age rule extended to nicotine-free vapes from 29 October 2026.

That difference is worth knowing, because it is the part of the Act that gets garbled most often. Tap the answer that applies.

Mixing the two rules up is easy, but they work in completely different ways.

How the 2027 tobacco rule applies

When was the buyer born?

June 2027: the advertising ban

From 1 June 2027, the Act brings in a ban on vape advertising and sponsorship, according to ASH. Expect to see far fewer vape adverts and brand tie-ins after that.

The ban sits alongside the 29 October 2026 changes on free samples and big discounts, so the overall direction is clear: less promotion of vapes, more emphasis on information.

What the Act has not done (yet)

Plenty of things have been talked about, but talk is not law. The packaging and display consultation ran from 10 July to 2 October 2026 and proposed plain packs, simple flavour names, plain device colours and keeping vapes out of sight in shops. Flavours were not proposed for a ban, and nothing has changed in law yet.

Vape-free places, including cars carrying under-18s, were consulted on with no start date. A licensing scheme for retailers and a product register are still to come.
