Can you vape at work in the UK? It depends on your boss

There is no single UK law that bans vaping at work. Smoke-free law is about smoking, so vaping is down to your employer's policy, and that varies from "anywhere you like" to "not on site, full stop". The trick is knowing where to look before you puff.

Smoking indoors at work is covered by smoke-free law. Vaping is not covered by that law, and there is no other single UK law that bans it at work. That leaves the decision with your employer.

Some workplaces treat vaping like smoking and send you to the same shelter. Some have a separate vaping area. Some allow it at desks, and some ban it anywhere on site. All of those are policies, not law, which is why your mate's office can do it one way and yours another.

So the real question is not "is it legal?" but "what does my workplace say?"

Find out where you stand

Most employers put their vaping rules in the staff handbook, often in the same section as smoking. If yours does not mention vaping at all, that is not permission. It just means nobody has written it down yet, so ask.

The answer can also depend on your role. Customer-facing jobs, client sites and work vehicles often have their own rules, even where the office itself is relaxed. Asking first costs you nothing; guessing wrong can cost you an awkward chat with your manager.

What a good vaping policy covers

If your workplace has a policy, it will usually answer a handful of practical questions. If it does not, these are the things worth asking about, so you are not caught out.

Breaks are a common one. Some employers count vape breaks like smoke breaks; others expect you to vape only in your normal breaks. Shared spaces are another: even where vaping is allowed, many policies keep it out of kitchens, meeting rooms and anywhere clients visit.

Plenty of vapers assume the smoking rules automatically cover them, and plenty of non-vapers assume the opposite. Both can be wrong, because vaping at work is a policy question.

That cuts both ways. An employer can choose to be relaxed about vaping, and an employer can choose to ban it outright. Neither is breaking the law by doing so. What matters is that the rule is clear and that you follow it.
